These actions were begun by the plaintiffs against Sheboygan county and the State Farm Mutual Automobile Insurance Company to recover damages for injuries to person and property. The complaints against Sheboygan county are based upon a claim that the highway was defective. The claims against the State Farm Mutual Automobile Insurance Company were based upon alleged negligence of its assured, Beverly Phillips, in the operation of his automobile which collided with the automobile driven by Victor John Conrardy, in which his wife, Catherine Mary Conrardy, was a guest-passenger. Beverly Phillips was killed as a result of the accident. The claims against the State Farm Mutual Automobile Insurance Company were settled and the complaints against it were dismissed upon the merits prior to the trial of the actions. The cases were consolidated for trial in the circuit court and upon this appeal.
